When purchasing from our online store, you are accepting the following E-store Terms and Conditions set out herein:
We reserve the right to alter, suspend or discontinue any aspect of this web site or its content or the goods and services offered. Further, unless otherwise stated, any new features, including new content and/or the sale of new goods, shall be subject to these Terms and Conditions.
All orders are subject to stock availability. Crop failures do at times occur and seed quantities may be limited. Our company is under no obligation to fill the order should supplies be unavailable. When items are out-of-stock it shall be posted on the website. We reserve the right to limit quantities ordered. Customers will be contacted should an item be back-ordered, cancelled, or if a price change has occurred.
Native seed is collected at Bearberry Creek’s Zone 2 nursery. Care is taken to ensure the seed is fresh, healthy, stored in suitable conditions, and shipped to our customers in appropriate packaging. Germination rates vary from season to season. Breaking dormancy through stratification, correct light and temperature requirements, etc. are the responsibility of the grower.
Seeds are living things. Growing conditions and production methods affect their performance. Factors such as fertilizers, weed control, fungicides, insecticides, disease- free soil, and reasonable weather conditions during the germination and growing period are totally out of the seedsman’s control and the grower takes on full risk and responsibility of his/her crop. Utmost care is taken to ensure the vitality and purity of the seeds. Packaged seed conforms to the label description as required by the Canada Seed Act.
If a breach of warrant, condition or contract occurs with respect to such seeds, in no case shall Bearberry Creek Water Gardens be liable for more than the price actually invoiced and/or paid for such seeds by the purchaser.
Shipments are sent prepaid. Freight charges are calculated online based on the value of the order and added to the order at the time of purchase. Long distance shipments, or those containing large or heavy items, may incur extra freight charges. In such cases, customers will be notified prior to shipping.
Bearberry Creek Water Gardens offers delivery via Canada Post, Loomis and Purolator from Sundre, Alberta. Greyhound freight is shipped from Olds, Alberta and is subject to an extra $20.00 charge to cover travel costs from our nursery to the Olds Greyhound Bus Depot.
Orders require 1-2 business days to process if materials are available at our location. Orders are shipped Monday through Friday. We do not ship on statutory holidays or weekends. In the event of a delay, customers will be contacted by email or phone. Deliveries are the responsibility of the carrier.
In the event that goods ordered have not been received within 10 working days, please contact us.
Prices posted on the website are subject to change.
Payments must be made in Canadian Dollars (CAD).
All payments must be made at time of purchase via Visa or MasterCard. In the case that a purchase has been made but the product is unavailable, the full purchase price shall be refunded to the customer.
GST and HST
GST and HST will be calculated and added to the order at the time of shipping.
Damage in Transit
Should goods be damaged in transit, the customer must advise us within 48 hours of delivery. Claims must be made with the carrier. Please retain all relevant documentation so that an insurance claim can be made against the carrier’s insurers. Bearberry Creek Water Gardens is not responsible in any way for goods damaged in transit.
If you receive a damaged parcel, please note your observations on the delivery form, even before you open the package to examine the contents. If you are unable to open the damaged package in the presence of the carrier, make sure that you sign for it as: “Damaged package, goods not yet inspected” or similar to warn the carrier that a claim may be forthcoming.
Please note that not all claims are honored by the carrier. Cost of the order, including shipping, will be refunded to the customer only if the damage claim is honored by the carrier. Please DO NOT return damaged goods to Bearberry Creek Water Gardens unless requested by us to do so, as this may incur unnecessary additional costs.
Should you feel the need to make a complaint about the services, products or the efficiency with which your order has been handled, please contact us by email. We aim to resolve complaints as quickly as possible. Such matters will be treated in the strictest confidence and you will be kept informed of the progress of the complaint if it relates to a third party (i.e. couriers).
Refunds, Returns and Exchanges
No returns, exchanges and refunds will be accepted without prior clearance through our office. Once clearance has been obtained, items can then be shipped back prepaid within 30 days of original invoice. Goods returned to us will be refunded in full, excluding postage and handling fees.
Personal information is collected solely for making online purchases and will not be disclosed to third parties. All private files are kept in a secure internal system. Financial information is always confidential and passwords are protected.
