When purchasing live plants from our nursery, you are accepting the following Terms and Conditions of Sale.
Prices
Prices are subject to change. Any price change will be brought to the attention of the customer prior to plant delivery. Prices are FOB our nursery.
Product Availability
All orders are subject to stock availability. Our company is under no obligation to fill an order should supplies be unavailable. When items are out-of-stock we shall notify our customers of the shortage as soon as possible. We reserve the right to limit quantities.
Custom Growing
On custom orders, a 15% non-refundable deposit must be paid to secure the order.
Payment
Payment must be made in Canadian dollars (CAD). GST will be added to the listed price. Payment is due at the time of purchase, prior to shipping, except in the case of established accounts which must be paid within 30 days of the invoice date. All overdue accounts will be charged 2% per month on the outstanding balance and sent to collection at six months, at the payee’s expense. Orders may be cancelled in the event of late payments.
Plant Survival
We do our utmost to ensure the correct identification, health and vitality of the plants we sell. Plant size and stage of maturation will vary, depending on weather and growing conditions, as well as the time of year sold. There is no guarantee, expressed or implied,of plant survival after leaving our care at the nursery.
Damage in Transit
If you receive a damaged shipment, please note your observations on the delivery form, even before you open the package to examine the contents. If you are unable to open the damaged package in the presence of the carrier, make sure that you sign for it as: “Damaged package, goods not yet inspected” to warn the carrier that a claim may be forthcoming. Damage in transit claims must be made directly to the carrier. Note that the cost of the order, including shipping, will be refunded to the customer only if the claim is honored by the carrier’s insurers. Do not return damaged goods to Bearberry Creek Water Gardens unless requested by us to do so, as this may incur unnecessary costs.
Complaints
If the customer is not satisfied
with the plant material received, claims will be reviewed by our office. In no case shall Bearberry Creek Water
Gardens be liable for more than the amount actually invoiced and/or paid for
such plants by the purchaser.
Returns
If authorized by our office to do
so, items can be shipped back, pre-paid by the customer. A 25% restocking
charge will be applied to a returned order.
Privacy Statement
Personal information collected
for making purchases will not be disclosed to third parties. All private files
are kept in a secure internal system.
Financial information is strictly confidential.
